1. General information

This Cancellations, Changes and Refunds Policy governs the conditions applicable to the purchase of tickets, reservations, places, invitations and other services marketed through EcoEntradas.com.

The platform is owned by:

LfanTink S.L.

NIF: B76318112

Registered office: Calle Virgen de la Peña, 2, 35600 Puerto del Rosario, Las Palmas, Spain.

EcoEntradas provides technology services for the marketing, reservation, issue and management of tickets for events that may be organised by independent entities.

The specific conditions of each event will apply insofar as they do not contradict the rights legally recognised to consumers.

2. General no-refund policy

Once the purchase has been confirmed, changes, cancellations or refunds of tickets will not be accepted for reasons attributable to the buyer's will or personal circumstances, except in the cases provided for by law or where there is express authorisation in accordance with the applicable conditions.

In particular, the following will not, by themselves, constitute grounds that confer a right to a refund:

  • Being unable to attend the event for personal, work or family reasons.
  • Having purchased tickets by mistake.
  • Having selected the wrong date, session, time or show.
  • Having selected a place, seat or rate other than the one desired.
  • Having purchased more tickets than needed.
  • Changes of plans, travel or personal availability.
  • Failure to attend the event.
  • Arriving after the established access time, provided that this condition has been communicated clearly and is legally valid.
  • Subsequently finding tickets at a lower price.

The buyer is responsible for checking the essential details of their order before confirming the transaction.

This responsibility does not exclude rights arising from errors attributable to the platform, incorrect information, contractual breaches or other legally protected circumstances.

3. Exclusion of the right of withdrawal

In accordance with Article 103(l) of Royal Legislative Decree 1/2007 of 16 November, the right of withdrawal does not apply, as a general rule, to service contracts related to leisure activities where they provide for a specific date or period of performance.

Consequently, tickets for concerts, shows, festivals, theatrical performances and other events with a specified date do not, as a general rule, have a 14-day withdrawal period.

The confirmed purchase is binding on the terms provided for by law.

This exclusion does not affect the buyer's rights in the event of cancellation, substantial modification, non-performance or other causes recognised by the legislation.

4. Changes requested by the buyer

As a general rule, voluntary changes will not be accepted of:

  • Event or show.
  • Date or session.
  • Time of the event.
  • Place or seat.
  • Type of ticket or rate.
  • Number of tickets purchased.

Any exceptional change will be subject to the conditions of the event and to the authorisation of the person competent to grant it.

The possibility of making changes for a given event will not automatically generate the same right for other events.

Where there are typographical errors in named data, the rights of rectification and the consumer-protection provisions that apply will be applied, without imposing charges contrary to the regulations.

5. Definitive cancellation of the event

Where an event is definitively cancelled before it is held and a refund is legally required, the buyer will be entitled to reimbursement of the amounts that correspond under the applicable legislation.

The organiser must communicate the cancellation and provide the information necessary to manage its consequences.

EcoEntradas will cooperate in processing the refunds that correspond to the services it provides, in accordance with its contractual position and its legal obligations.

In cases where a full refund is legally due, it will include the amounts paid for the tickets, including the management fees linked to the purchase.

No penalties or charges will be imposed for processing a legally mandatory refund.

6. Postponement or change of date

Where the organiser changes the date on which an event is held, it must communicate the new date and the applicable conditions.

The buyer may be offered the option of keeping their tickets for the new date, where that possibility is appropriate.

If the change constitutes a substantial modification and the buyer does not accept the alternative offered, the buyer may request a refund in accordance with the applicable legislation.

Acceptance of the new date must take place in accordance with a valid procedure.

The buyer will not be understood to waive non-waivable rights merely by not replying to a communication, unless there is a valid legal basis for attaching consequences to that failure to reply.

7. Substantial modifications of the event

Substantial modifications are those alterations that relevantly affect the essential conditions under which the ticket was purchased.

Depending on the circumstances, they may include:

  • A relevant change of date.
  • A change of venue or location that substantially alters the conditions.
  • Cancellation or replacement of a principal artist where that artist constitutes an essential element of the advertised show.
  • A significant alteration of the content or nature of the event.
  • Relevant modifications that affect the conditions of the service contracted.

In these cases the rights that legally correspond to the buyer will apply.

Not every secondary or ancillary modification will automatically give rise to a refund.

The assessment will depend on the contractual information, the characteristics of the event and the objective importance of the change.

8. Suspension of an event that has started

Where an event is interrupted after it has begun, the rights of attendees will be determined according to:

  • The cause of the interruption.
  • The duration and the part of the service actually provided.
  • The applicable regulations.
  • The existence of force majeure.
  • The valid contractual conditions.

Depending on the circumstances, a full refund, a partial refund or no refund may be due, in accordance with the legislation.

An automatic exclusion of liability will not apply merely because the show has started.

9. Force majeure and extraordinary circumstances

Events may be affected by extraordinary circumstances, including weather phenomena, emergencies, administrative restrictions or other events that prevent them from being held.

The existence of force majeure must be assessed in accordance with the applicable legal requirements.

Force majeure may affect liability for damages, but it will not necessarily mean that amounts paid for a service that is ultimately not provided may be retained.

Where appropriate, alternatives or refunds will be offered in accordance with the applicable legislation.

10. Unused tickets and non-attendance

Failure to use a ticket by the buyer's decision or personal circumstance will not, by itself, give rise to a right to a refund.

Non-attendance at the event will not automatically entail a reimbursement obligation for EcoEntradas or the organiser.

This rule will apply without prejudice to rights that may exist by reason of non-performance, incorrect information or other legally recognised causes.

11. Errors in the purchase

The buyer must check the information in their order before confirming the purchase.

EcoEntradas will provide mechanisms to review the essential details of the purchase in accordance with the applicable legal obligations.

Errors attributable exclusively to the buyer will not confer an automatic right to changes or refunds.

Where there is a technical, processing, charging or information error attributable to EcoEntradas or to the corresponding provider, the incident will be analysed and the legally required corrective measures will be applied.

Duplicate or improper charges must be corrected.

12. Duplicate, altered or fraudulent tickets

EcoEntradas may establish mechanisms intended to detect duplicate, forged, tampered or fraudulently used tickets.

Presentation of an altered ticket or of a ticket previously used may lead to its rejection where there is a legitimate cause.

Incidents must be investigated in a proportionate manner, taking into account the information available and the rights of the legitimate buyer.

Responsibility for a duplication or incident will not automatically be attributed to the buyer where it may be due to technical errors, acts of third parties or other causes beyond their control.

13. Named tickets

Where an event uses named tickets, the buyer must provide the data legitimately required for their issue.

The conditions for changing holders must be notified before contracting where they are relevant.

The correction of spelling or typographical errors in the name of the holder of a ticket purchased online will not give rise to additional charges where the applicable regulations prohibit this.

Changes of holder that constitute an effective transfer of the ticket may be subject to specific conditions that are legally valid.

14. Free tickets, invitations and accreditations

Invitations and free tickets will not, as a general rule, give rise to a right to a monetary refund where no amount has been paid.

Their use may be subject to conditions of access, identification and availability.

The cancellation of invitations or accreditations must be carried out in accordance with the applicable conditions and without infringing the rights legally recognised to the persons concerned.

15. Season tickets, passes and tickets for several events

Where season tickets or passes that allow attendance at several sessions or events are marketed, their specific conditions must state the content of the service contracted.

If a cancellation or substantial modification occurs that affects only part of a season ticket, a partial or full refund may be due according to the nature of the product, the importance of the modification and the applicable legislation.

A total exclusion of refund will not apply automatically merely because part of the season ticket has been used.

16. Management fees

Management fees that apply must be communicated before the purchase is confirmed and form part of the information on the total price.

Where a purchase remains validly in force and the buyer requests a voluntary cancellation that is not accepted, there will be no automatic right to recover the corresponding charges.

By contrast, where a full refund is legally due because of cancellation or substantial modification of the event, the management fees linked to the purchase that must be returned will be included.

Automatic deductions that are unfair or contrary to consumer regulations will not be applied.

17. Procedure for requesting a refund

Where there is a cause that may give a right to a refund, the buyer may send their request to:

[email protected]

To make it easier to locate and manage the transaction, it is recommended to indicate:

  • Order number or reference.
  • Name of the event.
  • Scheduled date of the event.
  • Email address used for the purchase.
  • Reason for the request.

EcoEntradas may request additional proportionate information where necessary to verify the transaction or prevent fraud.

Unnecessary documentation will not be required and unjustified obstacles will not be placed in the way of exercising legally recognised rights.

Where the request corresponds to the organiser, EcoEntradas may coordinate its processing, without prejudice to the obligations of its own that correspond to it.

18. Reimbursement procedure and means

Refunds will be made in accordance with the applicable legal and contractual procedure.

Where appropriate, the same means of payment used for the purchase will preferably be used, unless there is a valid agreement or legally justified circumstances.

The time limits will depend on the provisions applicable to the specific case and must respect the corresponding legal limits.

The time taken for the transaction to appear in the buyer's account may also depend on the financial institution or payment provider.

Vouchers, coupons or credits will not be imposed as a mandatory substitute for a monetary refund where the consumer is entitled to one.

19. Responsibility of organisers and of EcoEntradas

Organisers will be responsible for the obligations that legally and contractually correspond to them in respect of the actual holding of their events.

EcoEntradas will be responsible for the obligations arising from the technology, commercial or contractual services that it actually assumes.

The allocation of obligations to an organiser will not remove the liability of EcoEntradas where that liability is legally enforceable.

The economic allocation of responsibilities between organisers and EcoEntradas may be regulated in their professional contracts, without prejudice to the rights recognised to buyers.

20. Complaints and consumer rights

Buyers may submit enquiries, incidents or complaints through:

Email: [email protected]

Telephone: +34 928 296 726

Postal address: Calle Virgen de la Peña, 2, 35600 Puerto del Rosario, Las Palmas, Spain.

EcoEntradas will deal with complaints related to its activity and will provide information on the procedures that apply.

Users will retain their rights before the consumer authorities and the competent courts.

21. Specific conditions

Certain events may have specific conditions related to cancellations, changes, identification, accessibility or use of tickets.

These conditions must be provided clearly before contracting where they affect the buyer's rights and obligations.

Specific conditions may extend the consumer's rights, but they may not reduce those established as mandatory by the legislation.

22. Applicable legislation

This policy is governed by the applicable Spanish and European legislation, in particular:

  • Royal Legislative Decree 1/2007 approving the consolidated text of the General Law for the Protection of Consumers and Users.
  • Law 34/2002 on Information Society Services and Electronic Commerce.
  • Regional legislation on public shows and recreational activities that applies according to the place where the event is held.
  • Other regulations in force related to contracting, consumer protection and the provision of services.

23. Changes to the policy

EcoEntradas may update this policy in order to adapt it to legal or contractual changes, or to changes in the operation of the platform.

The new versions will be published on the website.

The changes will not retroactively affect buyers' rights or alter, to their detriment, the conditions validly agreed for previous purchases.
