LfanTink S.L., hereinafter EcoEntradas, is the entity that owns and operates the technology platform.

2. Purpose and nature of the platform

EcoEntradas.com provides technology services related to the publication, promotion, commercialisation, reservation, issue, distribution, administration and validation of tickets for events.

The services may include:

  • Sale of tickets over the Internet.
  • In-person sales through box offices.
  • Management of reservations and places.
  • Issue of electronic tickets.
  • Distribution of invitations.
  • Administration tools for organisers.
  • Processing and integration of payments.
  • Access control and ticket validation.
  • Sales statistics and reports.
  • Complementary technology services.

EcoEntradas may act as a technology provider, intermediary, retailer or seller, depending on the service and the corresponding contractual relationship.

The capacity in which it acts must be determined according to the actual circumstances of each transaction, the information provided to the buyer and the obligations assumed.

This Legal Notice does not, by itself, alter the responsibilities that legally correspond to each party.

3. Conditions of access and use

Access to the platform implies knowledge of these terms of use.

Acceptance of contractual conditions will take place where applicable, through the mechanisms provided.

The user undertakes to use EcoEntradas in a lawful, diligent manner and with respect for the rights of third parties.

The following is prohibited:

  • Using false identities for fraudulent purposes.
  • Altering reservations, orders or identifiers.
  • Duplicating or forging tickets.
  • Accessing unauthorised areas.
  • Interfering with payment systems.
  • Manipulating the availability of places.
  • Carrying out computer attacks.
  • Extracting information without authorisation.
  • Circumventing access controls.
  • Using the platform to commit unlawful activities.

EcoEntradas may adopt proportionate measures in response to conduct that compromises the security, integrity or operation of its services.

4. Delimitation of responsibilities

EcoEntradas may provide services to independent organisers and promoters.

Unless LfanTink S.L. is the organising entity or expressly assumes certain obligations, the production and the actual holding of each event will correspond to its organiser.

Among the obligations that may correspond to the organiser are:

  • The actual holding of the event.
  • Engagement of artists and suppliers.
  • Obtaining of licences and authorisations.
  • Security of the venue.
  • Compliance with the legal capacity conditions.
  • Accessibility of the event and its facilities.
  • Conditions of admission.
  • Programme and times.
  • Information provided about the show.
  • Communication of cancellations and changes.

EcoEntradas will be liable for its own legal and contractual obligations, especially those related to the technology and commercial services that it actually provides.

The involvement of an independent organiser does not automatically exclude the liability of EcoEntradas where that liability is enforceable under the legislation.

5. Information and responsibility of organisers

Organisers must provide truthful and sufficient information about the events they manage through the platform.

Where they act as professional users, they must keep the relevant event data up to date and communicate changes that may affect buyers.

The contractual relationship between EcoEntradas and the organisers may establish additional obligations of information, cooperation, indemnity, settlement and allocation of responsibilities.

Those obligations must be formalised in the corresponding professional contracts.

Publication of an event does not imply that EcoEntradas itself guarantees that it will be held where it is not the organising entity, without prejudice to the responsibilities that legally correspond to it.

6. Pre-contractual information

Before a purchase is confirmed, the following will be provided where legally required:

  • The identity of the seller or contractual provider.
  • The essential characteristics of the event.
  • The date and the place.
  • The total price.
  • Taxes and additional charges.
  • The relevant conditions of access.
  • The applicable restrictions.
  • The conditions of cancellation and refund.
  • The information on withdrawal that applies.
  • The means of payment accepted.

The contractual terms will be available before contracting and may be stored or reproduced on the terms required by the regulations.

The General Conditions of Purchase and the specific conditions of the event will supplement this Legal Notice.

7. Reservations and availability of places

The availability of tickets and places may vary during the purchase process.

The selection of a ticket or seat is not necessarily equivalent to a confirmed purchase.

Temporary reservations will be subject to the periods and conditions notified during the process.

If a temporary reservation expires before the procedure is completed, the places may be made available again to other users in accordance with the announced rules.

The existence of a browsing session or of a partially completed form does not guarantee the indefinite availability of tickets.

Incidents related to reservations or payments that have been started must be handled taking into account the actual status of the transaction, the amounts collected and the rights that correspond to the buyer.

8. Confirmation of purchase and delivery

The purchase will be confirmed in accordance with the applicable contractual and payment procedure.

EcoEntradas may use automated systems to issue tickets and send confirmations.

Delivery may be made by email, download from the website, user account or other announced means.

The buyer must provide suitable data in order to receive their tickets.

Where there is a delivery incident, the buyer may request assistance using the official channels.

The technical data of issue, sending and download may be used as evidence, in accordance with the Privacy Policy.

The generation or sending of a ticket will not allow it to be irrebuttably presumed that it was received or actually used.

9. Payments and financial transactions

Payments may be processed through external providers or systems enabled by the platform.

Information on the seller, the economic conditions and the applicable charges will be provided during the contracting process.

Collections, refunds and settlements will be managed in accordance with the contractual and operational structure actually used.

EcoEntradas may use payment references, transaction statuses and reconciliation records to check transactions and resolve incidents.

The involvement of third-party payment providers does not release EcoEntradas from its own legal or contractual obligations.

10. Fraudulent transactions and protective measures

EcoEntradas may apply security controls against suspicious transactions, abusive automated purchase attempts, misuse of means of payment, duplication of tickets and unauthorised access.

Where there are objective indications of fraud, it may adopt proportionate measures, including additional verifications, temporary restrictions or suspension of transactions, in accordance with the applicable legislation and the contractual conditions.

The actions must be based on reasonable and documentable criteria.

The application of preventive measures will not allow amounts paid to be unduly withheld or consumers to be deprived of their rights.

Where appropriate, relevant facts may be communicated to payment providers or competent authorities.

11. Chargebacks and payment claims

Bank refund or chargeback transactions will be handled in accordance with the applicable regulations and the procedures of the payment provider.

EcoEntradas may retain and provide the legitimate evidence related to:

  • The contract.
  • The authorisation and result of the payment.
  • The issue of tickets.
  • The information provided to the buyer.
  • The contractual conditions accepted.
  • The validation of the tickets.
  • The refunds made.
  • The communications related to the transaction.

The outcome of a bank claim will not, by itself, determine all the contractual responsibilities between the parties.

The economic relations between EcoEntradas and the organisers, including the consequences of chargebacks, must be regulated in the corresponding contracts.

12. Validity and use of tickets

Tickets may contain QR codes, barcodes or other electronic identifiers.

The use of tickets will be subject to the conditions of the event and to legitimate access controls.

Tampering with, alteration or forgery of a ticket may lead to its rejection and to the legal action that applies.

Incidents arising from duplicates, issue errors or validation errors must be analysed individually.

A legitimately purchased ticket may not be invalidated arbitrarily, nor may the buyer's rights be restricted by means of unfair terms.

13. Cancelled, postponed or modified events

Events may be subject to cancellations, postponements or modifications by decision of the organiser or due to supervening circumstances.

The determination of the buyer's rights and of the obligations of each party will depend on the applicable regulations and on the contractual relationship.

Where a refund is due, it will be handled in accordance with the corresponding legal and contractual obligations.

The organiser's responsibility for the actual holding of the event will not remove the obligations that EcoEntradas has assumed or that are legally enforceable against it.

The specific conditions must clearly identify the corresponding communication and claims procedure.

14. Right of withdrawal

In accordance with Article 103(l) of Royal Legislative Decree 1/2007, the right of withdrawal may be excluded in certain service contracts related to leisure activities where there is a specific date or period of performance.

This exception will apply only where its legal requirements are met.

The absence of a right of withdrawal does not remove rights arising from non-performance, cancellation or other causes recognised by the legislation.

The buyer will be informed of the applicable conditions before contracting.

15. Management fees and complementary services

EcoEntradas may apply management fees or other economic items where they apply and they are legally notified before the purchase is formalised.

The applicable amounts must be displayed clearly and form part of the information on the total price.

The nature of the charges and their possible refund will be determined in accordance with the service actually provided, the contractual conditions and the applicable legislation.

An absolute and indiscriminate exclusion of the refund of charges will not be established where it is contrary to consumer rights.

16. In-person sales and box offices

Organisers or authorised points of sale may use box-office systems integrated with EcoEntradas.

The use of these tools will be subject to permissions and professional conditions.

Box-office users must protect their credentials, devices and printing systems.

Where errors occur in in-person transactions, the corresponding correction, cancellation or refund procedures must be applied.

Responsibilities for cash handling, custody of devices, in-person transactions and the conduct of staff must be specified in the contracts with the owners of the points of sale.

17. Access-control systems

EcoEntradas may provide technology tools to verify tickets by means of authorised devices.

The organiser will be responsible for the physical organisation of access and for the security, capacity and admission obligations that legally correspond to it.

EcoEntradas will be liable for the obligations related to the technology system that it actually provides and for the contractual commitments assumed.

In the event of technical incidents, the parties must apply the contingency procedures established where they exist.

Liability for errors attributable to the technology service may not be excluded in general terms.

18. Technical incidents and continuity of the service

EcoEntradas will make reasonable efforts to maintain the availability and security of the platform.

Interruptions may occur due to maintenance, communications failures, incidents at providers, computer attacks or extraordinary circumstances.

EcoEntradas may temporarily suspend certain functions where necessary to protect the security or integrity of the service.

Where possible and appropriate, it will report relevant incidents.

Liability for interruptions or failures will be determined in accordance with the applicable regulations, the contractual relationship and the circumstances of each case.

Liabilities that cannot legally be limited will not be excluded.

Service levels and additional commitments to organisers must be established in the corresponding professional contracts.

19. Force majeure

Where extraordinary events occur that are beyond the reasonable control of the parties and prevent the performance of certain obligations, the corresponding legal regime will apply.

Among the circumstances that could be relevant, depending on the case, are certain natural disasters, decisions of competent authorities, widespread interruptions of infrastructure or unforeseeable or unavoidable events.

The classification of a circumstance as force majeure will depend on its legal requirements and on its causal relationship with the non-performance.

This clause does not automatically exclude refund obligations or the rights legally recognised to buyers.

20. Liability for published content

Organisers must hold the necessary rights over the posters, images, texts, logos and materials that they publish through EcoEntradas.

They must respect intellectual property rights, image rights, the right to honour, privacy and other rights of third parties.

EcoEntradas may remove or restrict content where there is sufficient legal or contractual justification.

The obligations and responsibilities will be determined in accordance with the applicable regulations, including the regime corresponding to intermediary services where it applies.

21. Intellectual and industrial property

The platform, its designs, programs, databases, interfaces, developments, trade marks, distinctive signs and own materials are protected by the applicable legislation.

The rights over the elements owned by LfanTink S.L. are reserved.

Access to EcoEntradas does not grant the user any licence to exploit the software or the protected content, except for the authorisations necessary to use the services legitimately.

The following is prohibited, without authorisation or legal entitlement:

  • Copying or distributing the software.
  • Commercially exploiting protected elements.
  • Circumventing protection systems.
  • Improperly accessing the code or reserved information.
  • Reproducing trade marks and distinctive signs in order to cause confusion.
  • Using third-party content without the necessary rights.

These prohibitions will be interpreted with respect for the exceptions and limitations recognised by intellectual property legislation.

22. Professional users and organisers

Organisers that use EcoEntradas must comply with the obligations established in their contracts and in the applicable regulations.

Among others, these may include:

  • Keeping information truthful and up to date.
  • Respecting capacity limits and access conditions.
  • Managing incidents properly.
  • Protecting access credentials.
  • Using only the authorised information.
  • Communicating changes and cancellations.
  • Complying with their tax and administrative obligations.
  • Respecting the rights of buyers.
  • Cooperating in the prevention of fraud.

Professional contracts may include clauses on indemnity, compensation, guarantees, suspension of services and allocation of responsibilities, within the applicable legal limits.

23. Suspension of accounts and services

EcoEntradas may restrict or suspend access where there is a legitimate cause, especially in the event of:

  • Proven fraud or objective indications that are sufficiently substantiated.
  • Serious security breaches.
  • Unauthorised access.
  • Material contractual breaches.
  • Unlawful use of the service.
  • Obligations imposed by competent authorities.

The measures must be proportionate, documented and applied in accordance with the legal obligations of information, reasoning or complaint that apply.

Suspension will not automatically extinguish obligations previously assumed or rights acquired by buyers.

24. Data protection and confidentiality

Personal data will be processed in accordance with the GDPR, the LOPDGDD and the Privacy Policy of EcoEntradas.

Access to personal data by organisers and professional users must be limited to legitimate and authorised purposes.

The corresponding contracts will establish the required commitments on confidentiality, security and data protection.

Authorised persons must avoid the improper disclosure of personal, contractual or commercial information.

25. Links and external services

The platform may integrate third-party services, such as payment gateways, communications providers, maps or other technology resources.

The conditions of these services may apply where appropriate.

EcoEntradas will not be automatically liable for every independent act of third parties, but it will retain the obligations that legally or contractually correspond to it by reason of its own involvement.

The use of external services does not imply a general exclusion of liability.

26. Commercial communications

Commercial communications will be carried out in accordance with the LSSI-CE and the GDPR.

Where required, prior consent will be requested.

Users may object or opt out through free and simple procedures.

For these matters the following may be used:

[email protected]

Communications necessary to perform a purchase or manage a ticket will not be commercial in nature merely because they are sent electronically.

27. Cookies

The use of cookies and similar technologies will be governed by the applicable regulations and by the Cookie Policy.

Technologies not exempt from consent will require the corresponding authorisation.

28. Complaints and user support

Incidents related to the platform may be reported to:

[email protected]

+34 928 296 726

EcoEntradas will handle the requests that correspond to its services and, where appropriate, will cooperate with the organisers to identify and process incidents related to the events.

Channelling a complaint to an organiser will not imply that EcoEntradas is exempt from its own responsibilities.

Consumers will retain their rights before the competent bodies and the courts.

29. Amendment of conditions

EcoEntradas may update the terms of use and the technical characteristics of its services.

Amendments will be published through the corresponding channels.

Where they affect contracts in force or require acceptance, the applicable legal requirements will be observed.

No update will allow the conditions of a purchase already formalised to be amended retroactively to the detriment of the consumer, except where there is legal authorisation or a valid agreement.

30. Partial nullity

If any provision of these conditions is declared void, invalid or unenforceable by a competent decision, that circumstance will not necessarily affect the remaining provisions, provided that they can validly subsist.

The affected clause will be subject to the consequences provided for by the corresponding legislation.

This provision will not allow an unfair term to be automatically replaced by another that produces equivalent effects to the detriment of the consumer.

31. Applicable legislation

These conditions are governed by Spanish legislation and by the provisions of the European Union that apply, including:

  • Law 34/2002 on Information Society Services and Electronic Commerce.
  • Royal Legislative Decree 1/2007 on the Protection of Consumers and Users.
  • Regulation (EU) 2016/679, the General Data Protection Regulation.
  • Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights.
  • Royal Legislative Decree 1/1996 on Intellectual Property.
  • Regulation (EU) 2022/2065 on Digital Services, where applicable.
  • The tax and electronic-commerce regulations that correspond to each transaction.

32. Jurisdiction

Disputes will be resolved before the courts and tribunals that are legally competent.

Where the user is a consumer, the mandatory rules on jurisdiction applicable to them will be respected.

In contractual relations between professionals, jurisdiction agreements may be established where they are valid under the legislation.
